APM ELIGIBLE TO CONTEST AS PRESIDENT

 


The opposition Democratic Progressive Party (DPP) has stated that Professor Arthur Peter Mutharika (APM) is eligible to contest as party President in  the upcoming general elections as well as the upcoming Party Convention in reference to the party Constitution , Writes Benjamin GK Nyirenda.


According to a letter released by the party signed by party Spokesperson Shadric Namalomba , Mutharika is still eligible to contest as party President as well as President in the upcoming general elections because he did not complete his second term of office as President of Malawi, as his re-election as President of Malawi was nullified by the High Court of Malawi on 3rd February and ultimately by the Supreme Court of Appeal on 8th May ,2020 which according to Article 10(5) of the DPP Constitution grants him eligibility.


The DPP Constitution according to Article 10 (5) states that "Where  the President of the party has been elected as President of the Republic of Malawi , that the Person shall remain President of the Party until he or she completes his or her second term of Office as President of the Republic of Malawi ", and  this automatically makes him eligible to contest as  Party President and also President of the Republic of Malawi.


The letter further assures Party Members and well wishers that APM is acting according to the Party Constitution and that the Party Constitution does not disqualify his Candidature .


APM has been the Party's torch bearer since 2014 after succeeding his late brother Dr Bingu Wa Mutharika who passed away in 2012 .
